TERMS AND CONDITIONS OF USE

By accessing the Website, submitting an inquiry, scheduling or participating in tutoring sessions, making a payment, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website or Services.

1. ELIGIBILITY; AUTHORITY TO ACCEPT TERMS

The Website and Services are intended for use by individuals who are at least eighteen (18) years of age or by parents or legal guardians acting on behalf of a minor student. By using the Website or Services, you represent and warrant that you have the legal capacity and authority to enter into these Terms.

If the student receiving tutoring services is under the age of eighteen (18), a parent or legal guardian must review and accept these Terms on the student’s behalf. The parent or legal guardian accepting these Terms represents and warrants that they have full legal authority to bind the minor and assume responsibility for the minor’s participation in the Services, compliance with these Terms, and all obligations arising therefrom.

Children under the age of thirteen (13) are not permitted to independently access or use the Website or Services. Any tutoring services provided to a child under thirteen (13) must be initiated, authorized, and supervised by a parent or legal guardian, and all information provided to Tutoring by Victoria must be submitted by the parent or legal guardian.

2. DESCRIPTION AND LIMITATIONS OF SERVICES

Tutoring by Victoria provides private academic and language tutoring services, which may be delivered online through third-party video conferencing or communication platforms. The specific subject matter, instructional format, session length, scheduling, and availability of Services are determined by mutual agreement between the parties and may vary from session to session.

The Services are educational in nature only. Tutoring by Victoria does not provide licensed educational assessments, standardized testing services, psychological services, therapeutic services, medical advice, or any other regulated professional services. No representation, warranty, or guarantee is made regarding academic performance, grades, test scores, language fluency, admission outcomes, or any specific educational result.

3. COMMUNICATIONS AND THIRD-PARTY PLATFORMS

Tutoring sessions and related communications may occur through third-party platforms, including but not limited to video conferencing, messaging, or scheduling tools. You acknowledge and agree that such third-party platforms are governed by their own terms of service and privacy policies and that Tutoring by Victoria is not responsible for the availability, security, data practices, or functionality of any third-party platform.

Tutoring by Victoria does not guarantee uninterrupted access to the Website or Services and is not responsible for technical issues, connectivity failures, hardware limitations, or internet disruptions affecting tutoring sessions.

4. FEES, PAYMENTS, AND FINANCIAL TERMS

All fees for tutoring services are disclosed prior to booking and are payable in advance unless otherwise expressly agreed in writing. Payments are processed through third-party payment processors. Tutoring by Victoria does not control, store, or assume responsibility for payment card data or financial information. You authorize Tutoring by Victoria and its payment processors to charge the applicable fees for the Services selected.

Failure to remit payment may result in suspension or termination of Services. Refunds, rescheduling, and cancellations are subject to the policies communicated at the time of booking or otherwise provided by Tutoring by Victoria. Tutoring by Victoria reserves the right to deny refunds for missed sessions, late cancellations, no-shows, or violations of these Terms, except where otherwise required by applicable law.

5. USER CONDUCT AND TERMINATION

You agree to use the Website and Services in a lawful, respectful, and appropriate manner. Any conduct that is abusive, harassing, threatening, discriminatory, sexually inappropriate, disruptive, or otherwise unacceptable, whether directed toward the tutor or any minor student, shall constitute a material breach of these Terms.

Tutoring by Victoria reserves the right, in its sole discretion, to suspend or terminate access to the Website or Services immediately and without refund if a User or student engages in conduct that violates these Terms or interferes with the provision of Services.

6. MINORS; PARENTAL RESPONSIBILITY AND SUPERVISION

Where Services are provided to a minor, the parent or legal guardian retains full responsibility for the minor’s participation. This includes responsibility for supervision during tutoring sessions, technical setup, appropriate learning environment, compliance with applicable laws, and accuracy of all information provided.

By enrolling a minor in the Services, the parent or legal guardian expressly consents to the minor’s participation in online tutoring sessions and acknowledges the inherent risks associated with internet-based communications, including potential technical failures and third-party platform risks. Tutoring by Victoria does not assume responsibility for monitoring or controlling a minor’s behavior outside of the tutoring session itself and does not provide childcare or supervision services.

7. INTELLECTUAL PROPERTY AND USE RESTRICTIONS

All content on the Website, including text, graphics, logos, designs, and educational materials, as well as all tutoring materials created, displayed, or provided in connection with the Services, are the exclusive property of Tutoring by Victoria or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use tutoring materials solely for personal, non-commercial educational purposes. You may not copy, reproduce, distribute, sell, sublicense, publish, publicly display, modify, or create derivative works from any materials without the prior written consent of Tutoring by Victoria.

8. PRIVACY AND DATA HANDLING

Tutoring by Victoria collects and uses personal information in accordance with its Privacy Policy, which is incorporated herein by reference. By using the Website or Services, you consent to the collection and use of information as described in the Privacy Policy. TUTORING BY VICTORIA DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TUTORING BY VICTORIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TUTORING BY VICTORIA’S TOTAL LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICES GIVING RISE TO THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tutoring by Victoria from and against any and all claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Website or Services, your violation of these Terms, your violation of applicable law, or your or the minor student’s acts or omissions.

12. FORCE MAJEURE

Tutoring by Victoria shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, internet or utility outages, governmental actions, labor disputes, illness, or technical failures.

13. MODIFICATIONS AND AVAILABILITY

Tutoring by Victoria reserves the right to modify, suspend, or discontinue the Website or Services at any time without notice. These Terms may be updated periodically, and continued use of the Website or Services constitutes acceptance of any revised Terms.

14. GOVERNING LAW AND VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Where tutoring services are provided to minors, participation must be authorized by a parent or legal guardian. The parent or legal guardian remains responsible for supervising the minor, ensuring an appropriate learning environment, and monitoring the minor’s participation during tutoring sessions.

Tutoring by Victoria is not responsible for technical failures, connectivity issues, device limitations, or interruptions caused by third-party platforms or services used in connection with tutoring sessions.

All instructional materials and educational content provided by Tutoring by Victoria are intended solely for the student’s personal, non-commercial educational use and may not be copied, distributed, or reused without prior written consent.
